The Council of State decided to refer to the CJEU for a preliminary ruling. The question submitted: “In the event of the temporary reintroduction of border controls, under the conditions provided for in Chapter II of Title III of Regulation (EU) 2016/399, can a foreigner coming directly from the territory of a State party to the Schengen Regulation signed on 19 June 1990 be refused entry during the checks carried out at that border on border, on the basis of Article 14 of said Regulation, without Directive 2008/115/EC being applicable?” (own translation)
