Three French organizations filed an action in annulment regarding the decision of the French government to temporarily reintroduce border checks at international border of the Schengen area. The organizations contested that the measures are in contravention with Article 26 of the Schegen Border Code preventing the free movement of people and deterring access to asylum to potential asylum seeker. The Court stated “that in the absence of urgency justifying the intervention of the judge of summary proceedings, it is necessary to reject the request presented by the applicant associations”.
