The Council of State confirmed in October 2019 a temporary border control decision that had been taken in 2018. The Council of State considered that the measure, adopted on the basis of “current events and the high level of the terrorist threat prevailing in France”, lead to a limitation of the freedom of movement that is proportionate to the aim pursued.
The applicants pursued this further through a complaint to the European Commission regarding the decision of the French authorities to reintroduce internal border controls.
