The Court found violations with regards to readmissions from Italy to Greece. 35 applicants from Afghanistan, Sudan and Eritrea were readmitted on independent occasions between 2008 and 2009 upon entering irregularly into the Italian ports of Bari, Ancona and Bari back to Greece. The applicants were expelled back to Greece via the Ionian Sea without being granted access to lodge an asylum application. Various violations were found for applicants against Italy, that the state violated Article 2 and 3 by returning the applicants to Greece without assessing that they could be at risk as Greece return nationals to their home country without prior assessment. It also found that the applicants were subjected to collective expulsions. With regards to Greece, the Court found a violation of Article 3 and Article 13.
