Ms X and Mr X, Eritrean nationals, had entered France irregularly and tried to apply for asylum with the support of an association in Breil-sur-Roya. They were subsequently returned to Italy by the border police. The applicants re-entered at a later date and requested that the authorities be ordered to issue them a receipt for the registration of their asylum applicationThe Court decided that by refusing to allow them to register their asylum application, the authorities had seriously and manifestly infringed the right to asylum. Moreover, the irregular situation of the applicants, who are destitute with a child constituted an emergency. The Court ordered the authorities to register the asylum application.
