In the present case, AA was stopped by the police on November 11, 2020, during a check carried out on a train from Italy entering the Menton-Garavan station. The court state that the station is an authorized railway crossing point. Under these conditions, the Court decided that the applicant could legally be the subject of an entry refusal decision taken on the basis of French legislation, in accordance with Article 14 of Regulation (EU) 2016/399
