Applicant S, Gambian national, had been checked on the night of 3 February 2020 while on French territory, that he had asked the police officers who had carried out the check to file an asylum application, that he had then been taken to and held at the Menton-Pont Saint Louis border post, where he had once again declared his intention to file an asylum application, after which he was expelled. The Court found that the applicant’s right to asylum had been infringed by the authorities. The Court also emphasized that the applicant had not sought asylum in Italy. It requested that the French authorities allow that the applicant is allowed to register an asylum application.
