The applicant, X, Sudanese national, was apprehended and immediately returned to Italy. The applicant stated that he expressed his wiill to apply for asylum but he was not allowed to lodge an application as he was expelled. The Court found that the reason for his expulsion was not substantiated except for the use of an English interpreter when the applicant spoke Arabic. The Court ruled in favor of the applicant and requested that the Prefect of Alpes-Maritime grants access to the applicant within forty-eight hours of the notification of the decision, onto the territory and to register his asylum application.
